Terms of Service

Who Can Use UltraKaizo

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian. By using the Service you confirm that you meet these requirements.

What UltraKaizo Is

UltraKaizo is free to play: a browser-based platform for a co-op (two player) kaizo challenge built on Pokemon Emerald. The Service runs an emulator in your browser and applies a fan-made patch to a game file that you provide. It offers features such as a run tracker, leaderboards, collectibles, and character skins. We may offer optional paid features in the future (for example a seasonal pass or cosmetic unlocks); if we do, we will publish the purchase terms before you buy. UltraKaizo is a fan project.

Not Affiliated With Nintendo

UltraKaizo is an independent fan project. It is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokemon Company, Game Freak, or any of their partners. Pokemon and all related names, characters, and assets are trademarks of their respective owners, and all rights to the original game belong to those owners.

Game Files and Copyright

UltraKaizo does not provide, host, sell, or distribute the original Pokemon Emerald game or any copyrighted Nintendo assets. To play, you must supply your own legally obtained copy of the original game. The patch is applied to your file inside your own browser. You are solely responsible for ensuring that your possession and use of any game file is lawful in your jurisdiction. You may not use the Service to upload, share, or distribute copyrighted game files to other users or to us.

Your Account

Signing in uses third-party authentication through Twitch or Discord. You are responsible for activity that happens under your account and for keeping your sign in method secure. Do not share your account or impersonate another person. We may suspend or close accounts that violate these Terms.

Acceptable Use

When using the Service, you agree not to do any of the following:

• Cheat, tamper with, or artificially manipulate runs, scores, or leaderboards.
• Exploit bugs to gain an unfair advantage or to disrupt other players.
• Harass, threaten, or abuse other players, including through co-op or community features.
• Upload or transmit malware, or attempt to gain unauthorized access to the Service or to other accounts.
• Use bots, scrapers, or other automated means that place an undue burden on our infrastructure.
• Distribute copyrighted game files through the Service.
• Reverse engineer the Service, except where that right cannot be limited by law.
• Use the Service for any unlawful purpose.

We may remove content, reset runs or scores, and suspend access to protect the integrity of the Service. We are under no obligation to monitor activity, but we may do so, and we may report unlawful activity to the appropriate authorities.

Leaderboards and Fair Play

Rankings depend on fair and accurate run data. To protect competitive integrity, we may review, adjust, reset, or remove runs and scores, including in cases of suspected cheating, exploits, or technical errors. Decisions about run integrity are made at our discretion.

Your Content

You may create content such as a display name, character skin choices, and co-op session data. You keep ownership of what you create, and you grant us a limited license to store and display it as needed to operate the Service. You are responsible for the content you submit, and you agree not to submit anything unlawful, offensive, or infringing. We may remove content that violates these Terms.

Local Data and Availability

Your game file and save states are stored locally in your browser. We are not responsible for the loss of local data, including saves and run progress, whether through browser changes, clearing storage, device failure, or updates to the Service. UltraKaizo is free to play, and we may change, suspend, or discontinue any part of the Service at any time without notice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR FREE, OR SECURE, OR THAT RUNS, SCORES, OR SAVE DATA WILL BE PRESERVED.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ULTRAKAIZO AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR FIFTY EUROS (EUR 50).

Indemnification

You agree to hold UltraKaizo and its operator harmless from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party, including claims related to game files that you supply.

Termination

You may stop using the Service at any time. We may suspend or end your access, with or without notice, if you violate these Terms or if we discontinue the Service. Your locally stored game file and saves remain on your own device.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the date below, and significant changes may be announced in the app. By continuing to use the Service after the changes take effect, you accept the updated Terms.

Governing Law

These Terms are governed by the laws of Italy, where the project is operated, without regard to conflict of law rules. Nothing in these Terms removes any consumer protection rights you may have under the mandatory laws of your country of residence.
